Terms of Service — Victory Lap Trail

1. Acceptance of Terms

By accessing or using Victory Lap Trail (the "App"), operated by Edgeset Marketing, LLC ("Company," "we," "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

2. Eligibility

You must be at least 13 years of age to use the App. By using the App, you represent that you meet this age requirement and that all information you provide is accurate and complete.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials
You are responsible for all activity that occurs under your account
You must notify us immediately of any unauthorized use of your account
We reserve the right to suspend or terminate accounts that violate these Terms

4. Acceptable Use

You agree not to:

Use the App for any unlawful purpose
Attempt to spoof GPS location or falsify check-in data
Create multiple accounts to gain unfair leaderboard advantage
Interfere with or disrupt the App or its servers
Attempt to reverse engineer, decompile, or extract source code from the App
Use automated scripts or bots to interact with the App
Harass, abuse, or harm other users

5. Physical Activity and Safety

⚠️ Victory Lap Trail requires you to travel to real physical locations. You are solely responsible for your safety at all times.

By using the App, you acknowledge and agree that:

You are solely responsible for your own safety while traveling to and visiting check-in locations
You will obey all traffic laws, parking regulations, and posted rules at each location
Some locations are at or near active roadways, racetracks, or public venues — exercise appropriate caution at all times
We are not responsible for any injury, accident, property damage, or loss that occurs while you use the App
You will not trespass on private property to complete a check-in

6. Intellectual Property

All content in the App — including location data, historical descriptions, scoring systems, achievement designs, QR codes, and the Victory Lap Trail name and branding — is owned by or licensed to Edgeset Marketing, LLC. You may not reproduce, distribute, or create derivative works without our express written permission.

Your username and any content you submit remains yours. By submitting content, you grant us a non-exclusive license to display it within the App.

7. Leaderboards and Scores

Leaderboard scores and achievement records are maintained by us and our systems. We reserve the right to adjust, remove, or reset scores in the event of detected cheating, technical error, or abuse. Score decisions are at our sole discretion and are final.

8. Availability and Changes

We do not guarantee uninterrupted availability of the App. We may modify, suspend, or discontinue the App or any feature at any time without notice. We may also update these Terms at any time. Continued use after changes constitutes acceptance.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE, SECURE, OR CONTINUOUSLY AVAILABLE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EDGESET MARKETING, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, PROPERTY DAMAGE, LOST PROFITS, OR DATA LOSS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability to you for any claim arising from use of the App shall not exceed $100 USD.

11. Indemnification

You agree to indemnify and hold harmless Edgeset Marketing, LLC, its members, officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the App, your violation of these Terms, or your violation of any third-party rights.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any dispute arising from these Terms or your use of the App shall be resolved in the state or federal courts located in Volusia County, Florida, and you consent to personal jurisdiction in those courts.
